All of that is correct and from what the article says he’s a real shitbag, who used violent language to coerce someone to sex. That’s definitely rape. I was interested what the legal system actually says, because 15 year olds also cannot consent to sex. However, many states use an age of 14 as barrier. Anyone under 14 is protected even against someone just 3 years older. So it sounds like this asshole can be tried.

Investigators are the ones to make that determination and they arrested him based on this video as well as other evidence. You don’t need to defend anyone raping someone under the age of 12.
