The Supreme Court on Friday allowed Idaho to enforce its strict abortion ban, even in medical emergencies, while a legal fight continues.

The justices said they would hear arguments in April and put on hold a lower court ruling that had blocked the Idaho law in hospital emergencies, based on a lawsuit filed by the Biden administration.

The Idaho case gives the court its second major abortion dispute since the justices in 2022 overturned Roe v. Wade and allowed states to severely restrict or ban abortion. The court also in the coming months is hearing a challenge to the Food and Drug Administration’s rules for obtaining mifepristone, one of two medications used in the most common method of abortion in the United States.

    This is at least only a temporary stay on a lower court ruling, a full ruling on this case can be expected in June, and I honestly don’t think it’s going to be as cut and dry for this conservative SCOTUS as people expect. Roberts and Kavanaugh in particular I think are likely to side with the federal government and the liberal justices on this one, and the mifepristone case.

      The fact that they stayed the lower court’s ruling may give some indication of where the court is leaning, though. My understanding of this kind of stay is that it is intended to allow the least injury to occur in the intervening period. The court appears to think that the least injury will be done by prohibiting mothers who are experiencing a medical emergency from receiving an abortion.

      The life of the baby is worth more than the life of the mother until it is born. Then it becomes riff raff like the rest of us.

      I know you’re just saying that there’s hope it isn’t permanent, but it’s so maddening to see these decisions that literally leave people to die. It’s such bullshit.
